Plaintiff-appellant Tastee-Freez Leasing Corporation (Trastee-Freez) filed its complaint against defendants-appellees Andrew Milwid and Darwin Vanderwall (lesses) seeking possession of real estate and damages upon a written lease. Trial to the court resulted in a judgment against Trastee-Freez. The trial found that Tastee-Freez was not entitled to possession of the leasehold, that lesses were not in default of any of the terms of the lease, that lessees had made over payments of rent from the inception of the lease, and that therefore lessees were not in default for nonpayment of rent.
